What is the Copyright Status of the Original Dub?

Maybe they just have no masters for it. Toei allegedly lost the film materials for the series, so it is completely understandable if they have lost the audio materials for the dub.
As long as they can get their hands on the old Pioneer DVDs, they'd have no problem releasing it. Discotek has released plenty of dub dubs from old VHS and LD releases. Toei didn't have the original Little Mermaid, so we used a VCD copy.

It is also a possibility that they assumed the old dub is something most fans don't want. Haters are, unfortunately, quite vocal... While I have no nostalgia to the old dub. It is always a possibility they simply safe it for a way to milk more from the franchise for future releases. I was interested in the new release for the subs. And while they are fateful as far as faithfulness goes, they are not the best as translation and the timing is not perfect either.

Yeah, it's absolutely possible to release the Optimum dub for S/SuperS and the movies (the unedited versions anyway). Viz likely just chose not to. If this was Discotek, that would probably be included as a third audio option. I guess it's possible Takeuchi would have to okay it's inclusion if Sailor Moon really is in such a unique situation.
